Terms & conditions
1. About us. thelymingtoncheese.store is run by Ninertate Limited, a company registered in England and Wales (company number 16799078) ("we", "us"), Unit 6, Braxton Courtyard, Lymore Lane, Milford on Sea, Lymington, Hampshire, SO41 0TX. We are registered as a food business with New Forest District Council. Contact us at jason.tate@btinternet.com or 07919 163319.
2. These terms. These terms apply to every order placed on our website. Please read them before ordering. By placing an order you agree to them.
3. Your order. Your order is an offer to buy. A contract is formed when we email you an order confirmation. We may decline an order, for example if an item is out of stock or your address is outside our delivery area. If we do, we will refund you in full.
4. Prices and payment. Prices are in pounds sterling. We are not VAT registered, so no VAT is charged. The minimum order value is £10. Local delivery costs £2.50 per order and collection is free. The charge is shown at checkout before you pay. Payment is taken at the time of order. Card payments are processed securely by Stripe; we never see or store your full card details.
5. Delivery area. At checkout you can choose delivery or collection (see section 7). We deliver only to addresses within 5 miles of our shop at SO41 0TX. If your address is outside this area, we will contact you and either arrange collection or cancel and refund your order.
6. Delivery times. We deliver Monday to Friday. After you order, we will contact you to arrange a delivery time. Someone must be available to receive the order. Cheese is perishable, so we cannot leave orders unattended unless you ask us to in writing, in which case the order is at your risk once delivered.
7. Collection. You may collect your order from Unit 6, Braxton Courtyard, Lymore Lane, Milford on Sea, SO41 0TX. Once your order is ready, we will contact you to arrange a collection time.
8. Perishable goods and cancellation. Our cheese and most other food products are perishable or sealed for health and hygiene reasons. Under the Consumer Contracts Regulations 2013, the usual 14-day right to cancel does not apply to these goods once they are prepared or dispatched. You may cancel free of charge before we start preparing your order by contacting us at jason.tate@btinternet.com.
9. Problems with your order. If an item arrives damaged, incorrect, or not of satisfactory quality, contact us within 24 hours of delivery with your order number and, where possible, a photo. We will replace the item or refund it. This does not affect your statutory rights under the Consumer Rights Act 2015.
10. Storage. Please refrigerate products on receipt and follow the storage guidance and use-by dates on the label. We are not responsible for deterioration caused by incorrect storage after delivery.
11. Allergens and product information. Our cheeses contain milk. Some products may also contain or have been produced near nuts, gluten, sesame or other allergens. Allergen details are shown on each product page and on the product label. If you have an allergy, please check the label or ask us before ordering. Nutrition information is a guide only and can vary between batches.
12. Product images. Cheese is a natural product. Size, colour and rind can vary from photographs, and weights are approximate where cut to order.
13. Gift boxes. Gift box contents may be substituted with an item of equal or greater value if a product is unavailable. We will tell you if this happens.
14. Our liability. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not liable for business losses. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud.
15. Changes to these terms. We may update these terms from time to time. The version on the website when you place your order applies to that order.
16. Law. These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or in your home nation if you live in Scotland or Northern Ireland.
